HANNIBAL JAYCEES LEASE AGREEMENT

 

This lease entered into this__________ day of________________________ _by and between the Hannibal Junior Chamber of Commerce, a Missouri not for profit corporation, hereinafter referred to as “Lessor”, and____________________________________________ hereinafter referred to as “Lessee”.

I.                    Lessor does hereby lease unto Lessee and Lessee does hereby accept the premises located in the City of Hannibal, County of Marion, State of Missouri, to-wit: 137 Jaycee Drive, together with all enclosed furniture and fixtures, subject to the covenants, terms and conditions set forth herein.

II.                  The term of this lease for a daytime rental shall begin 7:00am on the _______    day of_____________________ and commence at 5:00pm on the same day. Unless prior arrangements are made and stated in this lease.
The term of this lease for a evening rental shall begin 5:00pm on the ________  day of_____________ and commence at 11:59pm on the same day.  Unless prior arrangements are made and stated in this lease.

The term of this lease for a weekend rental shall be 5:00pm Friday the _________day of_____________ and commence at 12:00pm (noon) on Sunday the ___________day of________________.  Unless prior arrangements are made and stated in this lease.

III.                Lessee agrees to pay rent in advance in accordance with the following schedule:
Monday – Friday Days (7am-5pm)                     $ 85.00 per day +$ 50.00 deposit
Monday- Thursday & Sunday Nights (5pm – 11:59pm)         $ 85.00 per day + $ 50.00 deposit
Saturday –Sunday Days (7am – 5pm)                $ 150.00 per day + $ 50.00 deposit
Friday -Saturday Nights (5pm -11:59pm)          $ 150.00 per day + $ 50.00 deposit  
Weekend Rental (Friday 5pmSunday 12pm)       $350.00 + $ 100.00 deposit

Additional hours will be charged at a rate of $ 15.00 per hour.

IV.                In the event that Lessees hold over after termination of this Lease, they agree to pay Lessor’s, as liquidated damages a full night’s rent for any fraction of a night in which they hold over. In the event of any holding over by Lessees, Lessees also agree to pay Lessor’s Court and reasonable attorney’s fees occasioned by Lessees’ holding over.  In the event the premises are totally or partially destroyed by fire or other casualty prior to the rental date, Lessees may terminate this lease.

V.                  Lessee shall deposit with Lessor prior to the commencement of the term of this Lease the appropriate sum as described in section III of this lease as security for the full and faithful performance by the Lessee of all the covenants, terms and conditions contained in the Lease that said Lessee is required to perform hereunder.  Said deposit shall be returned to the Lessee after the expiration of the term of this Lease and inspection of property by Lessor. Premises shall be returned in as good condition as was received by the Lessee. Lessee agrees to clean the premises in compliance with the rules and regulations attached hereto and incorporated into this Lease. In the event of default by the Lessee of covenant, term or condition as set forth herein, Lessor may retain use or apply the whole or any portion of the security deposit in accordance with the attached list of fines and charges.  The security deposit does not limit liability of the Lessee for damages incurred during the term of this Lease caused by Lessee, its members, affiliates, and guests, invited or uninvited.   In the event of damage in excess of said damage deposit the Lessee is to provide Lessor three(3) estimates for repair within one( 1) week after surrender of premises, and Lessor shall have the discretion to accept or reject any bid and, if all bids are found to be unacceptable by Lessor, in its sole discretion, Lessor shall obtain its own bid or bids. Payment for repair, based on the bid selected by Lessor, is to made by Lessee to Lessor within (30) days of surrender of premises. 

VI.                A cancellation fee of $75.00 shall be paid by Lessee to Lessor if at any time a cancellation is made within 30 days prior to the rental date(s) reserved by Lessee. A cancellation fee of $100.00 shall be paid by Lessee to Lessor if a cancellation is made on the same date as the rental date(s) reserved by the Lessee.

VII.              The Lessee may use and occupy the leased premises for any lawful purpose. The Lessee shall not use of knowingly permit any portion of the leased premises to be used for any unlawful purposes.

VIII.            Lessee shall not sublet the premises, nor shall the Lessee in any manner permit the occupancy and use of the demised premises by another or others, except for invited guests of the Lessee.

IX.                The Lessee shall indemnify and hold Lessor harmless against all costs, expenses, liabilities, losses, damages, injunctions, suits, fines, penalties, claims and demands, including reasonable attorney’s fees’ arising out of any violation of or default in, any of the covenants,terms, and conditions contained herein, or arising out of any event, incident, accident, injury, or death occurring while traveling to or from the leased premises and involving the Lessee, its members, affiliates, and guests, invited or uninvited.

X.                  Any liability of Lessor to Lessee hereunder shall be fully satisfied, regardless of the facts giving rise to or the amount of such liability, by Lessors refund of rental payments and security deposit previously made by Lessee, less allowance for damages as stated herein.

XI.                It is hereby acknowledged that the person signing the Lease on behalf of any organization, association, corporation, or partnership is authorized to act on behalf of such organization, association, corporation, or partnership.
